General Terms and Conditions of Use and Sale — Fimelo

These General Terms of Use and Sale, hereinafter the "T&Cs", aim to define the conditions of access, use, subscription, and sale applicable to the Fimelo application.

The T&Cs are accessible within the application, via the "Me" > "Privacy & Legal" menu, as well as at the following address: https://axiocoach.fr/cgv/fimelo

The user is invited to read them carefully before any use of the application and before any subscription to a service.

Article 1 — Application Publisher

The Fimelo application is published by:

Benoît Rouyer, a natural person, currently establishing a business activity.

The publisher may update the administrative information related to his activity in the event of changes to his legal status, registration, domicile, or organization.

Article 2 — Concerned Application

These T&Cs apply to the Fimelo mobile application.

Fimelo is an application intended for creative hobby enthusiasts. It allows, in particular, the organization of creative projects, tracking their progress, saving photos, managing a gallery, creating wishlists, listing equipment, receiving creative ideas, and accessing certain help features powered by artificial intelligence.

The application is specifically aimed at users practicing creative hobbies such as scrapbooking, coloring, sewing, embroidery, painting, drawing, DIY, decoration, cardboard crafts, manual creation, or any other personal creative activity.

This list is indicative and not exhaustive.

Fimelo is intended for personal, creative, and organizational use.

The application is not intended for minors under 15 years of age without the authorization of their legal representative.

At launch, the application is primarily intended for the French market.

Article 3 — Acceptance of the T&Cs

The use of the Fimelo application implies the acceptance of these T&Cs.

The user must accept the T&Cs and the privacy policy when creating an account and/or subscribing to a service.

This acceptance may take the form of a checkbox, a validation button, or any other equivalent positive action implemented in the application.

The user acknowledges having read these T&Cs before using the application or subscribing to a service.

If the user does not accept these T&Cs, they must not use the application.

Article 4 — Service Description

Fimelo offers, in particular, the following features:

  • creation and tracking of creative projects;
  • classification of ongoing projects;
  • archiving of completed projects;
  • adding photos to projects;
  • personal creative gallery;
  • voluntary sharing of photos to social networks or third-party applications;
  • management of a creative wishlist;
  • management of creative equipment and materials;
  • ideas of the day;
  • creative suggestions;
  • creative project assistance;
  • generation of visual compositions or montages assisted by artificial intelligence;
  • reminders and notifications related to projects;
  • access to certain premium features;
  • personalization of the user experience.

This list is indicative. The application may evolve over time.

Fimelo may add, modify, suspend, or delete certain features to improve the service, fix bugs, comply with legal obligations, or adapt the application to user needs.

Article 5 — Use of Artificial Intelligence

Fimelo may use artificial intelligence to assist the user with certain features, including:

  • generation of creative ideas;
  • help with creating or organizing a project;
  • suggestion of titles, steps, themes, or inspirations;
  • analysis of photos voluntarily imported by the user;
  • generation of photo montages or creative visuals;
  • help with structuring wishlists or equipment;
  • personalized suggestions according to the user's creative universe.

The content generated by the application constitutes suggestions for creative help and personal organization.

The user acknowledges that automatically generated content may contain errors, approximations, inconsistencies, visual imperfections, unsuitable proposals, or incomplete information.

Generated content must be reviewed, adapted, and validated by the user before any use, publication, sharing, or reproduction.

Fimelo does not guarantee absolute originality, exclusivity, artistic compliance, professional quality, or the absence of resemblance to existing creations.

The user remains solely responsible for the use they make of the content generated by the application.

Article 6 — Absence of Creative Achievement Guarantee

Fimelo is a tool for assistance, organization, and inspiration.

The application does not guarantee any artistic result, any final quality, any project success, any creative progression, any absolute originality, any public recognition, any commercial result, or any compliance with a particular creative technique.

The user acknowledges that their results depend on many factors external to the application, including their experience, tastes, equipment, available time, working method, creative practice, and their interpretation of the proposed suggestions.

Article 7 — Account Creation

A user account is mandatory to access certain features, synchronize data, keep history, use premium functions, or save content.

The user can create an account using their email and a password. They may also use Google or Apple if these options are available.

Login with Google and login with Apple may be offered at launch or added later.

The user agrees to provide accurate, complete, and up-to-date information when creating their account.

The user is responsible for the confidentiality of their login credentials.

They agree to inform Fimelo without delay in the event of fraudulent, suspicious, or unauthorized use of their account.

Article 8 — Personal Account and Prohibition of Sharing

Each account is personal, individual, and cannot be shared with other users.

The user is prohibited from communicating their credentials to a third party or allowing the use of their account by another person.

A family, group, creative club, or multi-user offer may be proposed later.

Pending the potential implementation of such an offer, any account sharing is prohibited.

Article 9 — Subscription and Premium Access

The Fimelo application is free to download.

Certain basic features may be accessible for free.

Advanced features are reserved for subscribed users.

Premium features may include:

  • advanced AI assistance;
  • photo montage generation;
  • personalized creative suggestions;
  • extended number of projects;
  • expanded gallery access;
  • advanced project organization;
  • additional creative ideas;
  • enriched backup;
  • exclusive features related to projects, wishlist, or equipment.

This list is indicative and may evolve.

At launch, no free trial is planned.

The subscriptions offered at launch are as follows:

  • monthly subscription: €3.99 incl. tax per month;
  • annual subscription: €39.99 incl. tax per year.

Prices are shown inclusive of all taxes.

The applicable prices are those displayed in the application, on the Apple App Store, or on Google Play at the time of subscription.

Fimelo reserves the right to modify its prices at any time, in compliance with the rules applicable to the platforms concerned.

Article 10 — Payment

Subscription payments are managed via the Apple App Store and Google Play.

RevenueCat is used to technically manage subscriptions, premium statuses, and synchronization with the Apple App Store and Google Play.

Fimelo does not directly store user bank data or payment methods.

Payment data is processed by Apple, Google, RevenueCat, and their technical service providers according to their own contractual conditions and privacy policies.

Stripe may be added later but is not used at launch.

Article 11 — Automatic Renewal

Unless otherwise indicated at the time of subscription, subscriptions are automatically renewed at each term.

The monthly subscription is renewed every month.

The annual subscription is renewed every year.

The user is responsible for managing their subscription from their Apple App Store or Google Play account.

Article 12 — Subscription Cancellation

The user can cancel their subscription at any time from their Apple App Store or Google Play account settings.

Premium access remains active until the end of the period already paid for.

Deleting the Fimelo account does not automatically cancel a subscription purchased via the App Store or Google Play.

The user must manage their subscription separately from their Apple or Google account.

Article 13 — Refund

Refund requests are processed according to the rules of the Apple App Store or Google Play, depending on the platform used for the purchase.

Fimelo does not directly manage refunds for payments made via the stores.

The user must address their refund requests to Apple or Google depending on the platform used for the purchase.

Article 14 — Right of Withdrawal

The user acknowledges that access to the digital features of the application may begin immediately after subscription.

The right of withdrawal, where applicable, is exercised according to the rules of the Apple App Store or Google Play.

The applicable terms may vary depending on the platform, country, type of purchase, user status, and the rules specific to digital services.

Article 15 — Account Deletion

The user may request the deletion of their account from the application or by email at the following address: app@axiocoach.fr

Account deletion results in the deletion or anonymization of associated data within a maximum period of 30 days, unless otherwise required by law.

Deleting the account does not automatically cancel a subscription purchased via the App Store or Google Play.

The user must therefore cancel their subscription directly from their Apple or Google account if they wish to end the automatic renewal.

Article 16 — User Support

User support can be reached at the following address: app@axiocoach.fr

Fimelo endeavors to respond to support requests within 72 business hours, as far as possible.

This timeframe is indicative and does not constitute a guarantee of a response within a specific period.

Article 17 — User Obligations

The user agrees to use the application in accordance with these T&Cs, applicable laws, and third-party rights.

The user specifically prohibits themselves from:

  • using the application for illegal, fraudulent, abusive, discriminatory purposes or those contrary to public order;
  • infringing on the rights of third parties;
  • bypassing or attempting to bypass access limitations, the subscription, or paid features;
  • disrupting the operation of the application;
  • copying, reproducing, reselling, or unauthorizedly exploiting the application;
  • sharing their account with a third party;
  • voluntarily entering sensitive or highly confidential data not necessary for the use of the service;
  • importing content protected by intellectual property rights without authorization;
  • using generated content to create, feed, or improve a competing service.

Article 18 — Content Entered or Imported by the User

The user is solely responsible for the content they enter, import, upload, or save in the application.

This content may include:

  • photos of creations;
  • photos of material;
  • photos of products;
  • project names;
  • descriptions;
  • progress steps;
  • personal notes;
  • wishlists;
  • equipment;
  • comments;
  • images used for AI functions.

The user guarantees that they have the necessary rights to the content, information, texts, photos, images, or elements they provide in the application.

They agree not to import content belonging to third parties without authorization.

Fimelo is not intended to receive sensitive, confidential data or data belonging to third parties without authorization.

The user must limit the information entered whenever possible.

Article 19 — Photos, Gallery and Sharing

Photos added by the user in Fimelo are intended for the personal organization of their projects and the management of their creative gallery.

User photos are not automatically published by Fimelo.

Sharing to social networks, messaging, or third-party applications is triggered only by a voluntary action of the user.

When the user chooses to share a photo or content to a third-party service, this sharing is subject to the terms of use, privacy rules, and parameters of that third-party service.

Fimelo cannot be held responsible for the use, dissemination, republication, or conservation of content after its voluntary sharing by the user to an external service.

Article 20 — Sensitive Data

Fimelo does not voluntarily collect sensitive data.

The user is invited not to enter sensitive data into the application.

Specifically considered sensitive are data relating to health, political opinions, religious beliefs, ethnic origin, sexual orientation, biometric data, or genetic data.

Article 21 — Use of Generated Content

The user may use, adapt, record, and share content generated by Fimelo for their personal and creative use, under their own responsibility.

They may not resell it, republish it massively, integrate it into a competing service, or exploit it in a way that infringes upon the rights of Fimelo or third parties.

The user acknowledges that generated content must be adapted to their project, their practice, their level, their tastes, and any rules applicable to the content used.

Article 22 — Intellectual Property

All elements composing Fimelo, including the brand, name, interface, content, text, visuals, features, databases, graphic elements, and the structure of the application, are protected by applicable intellectual property rights.

Any unauthorized reproduction, copying, resale, extraction, adaptation, dissemination, modification, or exploitation is prohibited.

The use of the application does not confer upon the user any ownership rights over Fimelo, the Fimelo brand, the interface, the features, the content, or the technical elements of the application.

Personal content imported by the user remains the property of the user or their legitimate holders.

However, the user grants Fimelo a limited technical authorization to host, process, display, back up, and, if necessary, transmit this content to technical service providers strictly to enable the operation of the service.

Article 23 — Application Availability

Fimelo strives to ensure access to the application but does not guarantee permanent, continuous, or uninterrupted availability.

Temporary interruptions may occur, notably for maintenance, updates, bugs, technical incidents, third-party provider malfunctions, mobile platform constraints, or causes beyond the editor's control.

Fimelo cannot be held responsible for temporary interruptions, slowdowns, loss of access, or unavailability related to technical, external causes or causes beyond its control.

Article 24 — Evolution of the Application

Fimelo may evolve at any time.

Features may be added, modified, suspended, or deleted to improve the service, fix bugs, comply with legal obligations, or adapt the application to user needs.

The user acknowledges that the application is likely to evolve regularly.

Article 25 — Account Suspension or Deletion by Fimelo

Fimelo may suspend or delete an account in the event of a serious or repeated violation of these T&Cs, fraudulent use, abuse, attempted bypass of the subscription, unauthorized account sharing, or infringement of the proper functioning of the application.

Whenever possible and appropriate, Fimelo may inform the user of the reasons for the suspension or deletion.

Article 26 — Personal Data

Fimelo collects and processes certain personal data necessary for the operation of the application.

The data collected may include:

  • account data;
  • usage data;
  • content voluntarily entered by the user;
  • photos voluntarily imported by the user;
  • information related to projects;
  • wishlist;
  • equipment;
  • creative preferences;
  • subscription information;
  • technical data necessary for the operation of the application.

Fimelo does not collect precise location data unless a specific feature requires explicit authorization.

Fimelo does not directly store bank data or payment methods.

Fimelo does not voluntarily collect sensitive data.

Personal data is processed in accordance with Fimelo's privacy policy.

Article 27 — Technical Services and Providers

The application uses several technical services necessary for its operation.

Third-party services used may include:

  • Lovable Cloud for the backend, application hosting, or certain technical services;
  • RevenueCat for subscriptions;
  • Apple App Store and Google Play for payments;
  • Google and Apple for authentication;
  • artificial intelligence providers used via Lovable Cloud or technical functions integrated into the application;
  • an email service associated with the axiocoach.fr domain and/or technical providers necessary for sending service emails;
  • storage or processing services necessary for photos, projects, and account data.

These providers intervene only to the extent necessary for the functioning, security, improvement, or provision of the service.

Article 28 — Commercial Communications and Partners

Fimelo may send information, news, product improvement, or commercial offer emails related to its services only if the user has agreed to receive these communications.

Emails necessary for the operation of the service may be sent regardless of marketing consent.

Fimelo does not freely resell users' personal data.

Certain data may be transmitted to commercial partners only with the user's specific consent.

This consent must be collected through a specific positive action, distinct from the acceptance of the T&Cs and the privacy policy.

Checkboxes relating to commercial communications and potential transmission to commercial partners must be optional, separate, and not pre-checked.

The user may withdraw their consent at any time.

Article 29 — Push Notifications

Fimelo may send push notifications related in particular to:

  • project reminders;
  • ideas of the day;
  • progress tracking;
  • creative suggestions;
  • premium features;
  • organizational reminders;
  • application news.

These notifications are subject to user agreement when such agreement is required.

The user can accept or refuse push notifications from their device settings.

Refusing notifications does not prevent the use of the application but may limit certain reminders or support.

Article 30 — Technical Data, Cookies and Trackers

Fimelo may collect technical data necessary for operation, security, diagnostics, bug fixing, and application improvement.

The application may use technologies necessary for the service operation, authentication, security, session management, and technical measurement of use.

Trackers that are not strictly necessary will be subject to user consent when regulations require it.

The user may, where available, manage their preferences from the application or from their device settings.

Article 31 — GDPR Rights

The user can exercise their rights over their personal data, in particular their rights of access, rectification, deletion, opposition, limitation, and, where applicable, portability.

In the event of account deletion, data is deleted or anonymized within a maximum of 30 days, unless otherwise required by law.

Article 32 — Liability

Fimelo provides a tool for help, organization, and creative inspiration.

The user remains solely responsible for:

  • the use they make of the application;
  • the content they enter;
  • the photos they import;
  • the content they share;
  • the creations they make;
  • the creative decisions they take;
  • the use of AI suggestions;
  • respecting third-party rights;
  • respecting rules applicable to protected content.

Fimelo cannot be held responsible for consequences related to misuse of the application, misinterpretation of suggestions, lack of verification of generated content, unauthorized importation of third-party content, or a voluntary sharing carried out by the user.

Article 33 — Force Majeure

Fimelo cannot be held responsible in the event of non-performance or poor performance of its obligations resulting from a force majeure event or an event reasonably beyond its control.

This may include network failures, hosting interruptions, failures of third-party providers, cyberattacks, restrictions imposed by Apple or Google, administrative decisions, natural disasters, or unpredictable technical events.

Article 34 — Modification of the T&Cs

Fimelo may modify these T&Cs to reflect changes in the service, regulations, features, commercial offers, technical providers, or the publisher's organization.

The user will be informed of significant modifications when necessary.

The date of the last update is indicated at the top of the document.

Article 35 — Proof and Traceability

Fimelo may keep proof of acceptance of the T&Cs, the privacy policy, optional consents, and major actions related to the user account.

These elements may be used for security, proof, compliance, or service management purposes.

Article 36 — Applicable Law

These T&Cs are subject to French law.

As the application is published from France and primarily intended for the French market at launch, French law applies to the use of the application and the relationship between Fimelo and the user.

Article 37 — Dispute Resolution

In case of difficulty, the user is invited to contact Fimelo at the following address: app@axiocoach.fr

The parties will strive to seek an amicable solution before any legal action.

Article 38 — Mediation

If the user is considered a consumer within the meaning of applicable law, they may resort free of charge to a consumer mediation scheme, in accordance with the provisions of the Consumer Code.

Before referring to a mediator, the user must first send a written complaint to Fimelo at the following address: app@axiocoach.fr

In the absence of a response or in the event of an unsatisfactory response, the user may consult the official online dispute resolution platform set up by the European Commission or any competent mediation scheme provided for by the applicable regulations.

Article 39 — Competent Court

For professional users, in the absence of an amicable resolution, disputes shall fall under the jurisdiction of the competent courts in accordance with French law.

For consumer users, the legal rules of jurisdiction applicable to consumers apply.
